Investor’s Right to Submit a Grievance
Every investor operating in Jordan has the right to submit a formal grievance to the Ministry of Investment under the following circumstances:
- Investors have the right to refer to the Ministry of Investment to submit a grievance request against any decision or action taken or not taken by an official entity, if such decision or omission affects the investor’s rights and guarantees as stipulated in the applicable legislation, international investment agreements to which the Kingdom is a party, or contracts concluded between the investor and the official entity.
- The grievance request must be submitted within the timeframes specified in the relevant international investment agreements to which the Kingdom is a party, or in the contracts concluded between the investor and the official entity.
- Investors may not submit a grievance request if they have already filed a legal challenge before the competent court or initiated procedures under alternative dispute resolution mechanisms.
- Submitting a grievance request under this regulation shall not be considered a judicial appeal before the competent courts, nor shall it be deemed recourse to alternative dispute resolution. It shall also not affect the rights granted to the investor under international agreements to which the Kingdom is a party.
Grievance Review Process
The grievance committee at the Ministry of Investment carefully reviews all submitted requests and coordinates with the relevant authorities to ensure timely and efficient resolution. This process helps accelerate procedures, minimize delays, and ensures that all grievances are handled with the highest standards of transparency and fairness.
The committee is responsible for reviewing appeals to verify the validity of procedures or decisions issued by the competent authorities, ensuring their proper implementation of relevant legislation and compliance with international investment agreements to which the Kingdom is a party, as well as contracts concluded between these authorities and investors.
The committee also studies the challenges facing economic activities and works to address them in ways that support the continuity and growth of the national economy.
